The Islamabad High Court on Wednesday did not grant immediate relief to 20 sub-lease holders and apartment owners of One Constitution Avenue in a case related to the cancellation of the project’s main lease.
A division bench comprising Justice Muhammad Azam Khan and Justice Inam Ameen Minhas heard intra-court appeals filed by several affected individuals, including former air chief Mujahid Anwar Khan, former ICC president Ahsan Mani, former Senate chairman Wasim Sajjad, and others.
The appeals challenge an earlier decision, with the appellants seeking protection of third-party rights up to paragraph 30 of the ruling.
During the hearing, advocates Taimur Aslam and Ali Raza appeared on behalf of the appellants, while Kashif Ali Malik represented the Capital Development Authority.
The court observed that the matter before it concerned the rights of the affected owners and not BNP.
In response, CDA’s counsel told the bench that the CDA board would decide the issue in accordance with the law.
The court then directed the CDA to seek instructions and submit a written reply in the case. Further hearing was adjourned until May 25.
