The Federal Constitutional Court has issued a landmark judgment aimed at strengthening transparency and protecting the rights of government employees across Pakistan.
The court directed all government departments and autonomous bodies to publish updated seniority lists on their official websites every year, ensuring public access and administrative transparency.
The judgment declared that access to seniority information is a constitutional and fundamental right of both citizens and employees, and ruled that such records cannot be concealed by any department or authority. It stressed that transparency in public administration is essential for fair governance and institutional accountability.
The court further held that for employees recruited in the same batch, seniority must be determined strictly on the basis of merit ranking rather than date of joining. It was observed that the “first come, first served” principle is not consistent with fair administrative standards and cannot be used as a lawful basis for fixing seniority in such cases.
In addition, the court declared the seniority list issued by the Port Qasim Authority null and void, set aside the Sindh High Court’s earlier ruling, and accepted the appeal filed by Captain Muhammad Ali Khan.
It directed all federal and autonomous institutions to update seniority lists every January and immediately after any recruitment, promotion, or regularization exercise, while also instructing chief secretaries of all provinces to ensure full implementation of the verdict.
