The Federal Constitutional Court has struck down a notification that granted lifetime additional perks to former Balochistan chief secretaries and their widows.
The court also dismissed an appeal filed by the Balochistan chief secretary against an earlier ruling of the Balochistan High Court.
Justice Aamer Farooq issued a four-page order, saying every action taken against the law is unjustified. The court said there is no legal room to grant such benefits to retired officers or their families.
The court ruled that pension and post-retirement benefits can only be granted under the law. It also said only the Finance Department has the authority to make rules on such matters.
The order further said the finance minister and the chief secretary do not have the power to approve these benefits.
The court also declared that the approval granted by the Balochistan chief minister for additional perks was unlawful. It said the Constitution allows only those executive actions that are not barred by law.
The Balochistan government had earlier granted lifetime benefits to former chief secretaries and their widows. However, the Balochistan High Court had already declared the move illegal.
The provincial government later challenged that decision in the Federal Constitutional Court, but the appeal has now been dismissed.
